ROCKY RIVER CHARTER - ARTICLE 3 - THE COUNCIL

TO AMEND: SECTION 1. POWERS AND MEMBERSHIP.

SECTION 1. POWERS AND MEMBERSHIP.

(A) The legislative powers of the City, except as otherwise provided in this Charter and by the Constitution of the State of Ohio, shall be vested in and exercised by a Council consisting of five (5) members, one (1) of whom shall be elected from each of five (5) wards in the City.  In addition to any powers, duties or obligations, as set forth in this Charter, Council shall have such further powers, duties or obligations as are set forth in the general laws and the constitution of the State of Ohio to the extent not in conflict with this Charter; and in the event that there is such a conflict then those granted, allowed or imposed by this Charter shall prevail.

(B) On the date this section becomes effective council shall begin to establish a fifth ward located within the Municipal Corporation of the city of Rocky River, County of Cuyahoga and State of Ohio and said ward shall be called Ward Five.

(C) Council shall adopt and codify laws that will establish the 'decision making process and funding' to be given directly to the said established five (5) wards' council representatives necessary to carryout separate and combined ‘maintenance, upkeep and development’ of the said established five (5) wards.

(D) On the date subpart (B) becomes effective A 'WARD 5 SPECIAL MUNICIPAL ELECTION' SHALL TAKE PLACE WITHIN SIXTY (60) DAYS TO ELECT WARD 5 COUNCIL MEMBER.

(1) 'Candidates for said election' shall come from 'any and all electors' qualified to run for council and 'any and all said electors' shall carry out requirements to become 'a candidate' for council - as set forth by this charter. 

(2) Council shall pick any further ‘said candidate(s)’ if needed.

(E) Council shall adopt and codify any further laws that will direct the process necessary to carryout ‘said special election’.

 

(F) All ordinances, resolutions, proclamations, motions and Charter provisions inconsistent with this subpart are hereby repealed and declared null and void.

 

(G) This section shall be severable and if any part, word or application thereof is held invalid for any reason, such holding shall not invalidate or affect the force and effect of any other part, word or application therof.
