JOBS for ROCKY RIVER RESIDENTS

How?  By A Rocky River City Charter Addition: (Shown Below)

 

What?  Guarantee jobs for Rocky River Residents for government contract work - that takes place in the City of Rocky River.

     City Government will require contractors who work within the city - to hire Rocky River residents for 20% of jobs while 7% of those jobs are for unemployed Rocky River residents to be hired - on projects by city or other government jurisdictions - in which the contract is $100,000 and above.

     The Director of Safety-Service shall monitor and report to council that Rocky River residents are being properly hired, work and paid. 

 

Who?  Residents who want a job and are willing to work - will have a job in Rocky River.

     Rocky River residents currently out of work - will also have a pre-determined amount of positions available for them as well.  So they too, can work where they and their families live - in Rocky River. 


ROCKY RIVER CHARTER - ARTICLE 10 - GENERAL TO ADD:

SECTION 9.  MUNICIPAL CONSTRUCTION CONTRACTS - MANDATORY RESIDENT JOBS.

  

(A) MANDATORY RESIDENT JOBS

 

(1) Where not otherwise prohibited by federal, state or local law or the terms of federal or state grants, all Construction Contracts of $100,000 or more, shall contain a provision that requires that Residents of the City perform twenty percent (20%) of the total Construction Worker Hours ("Resident Construction Worker Hours") and council shall contain a provision detailing the penalties for failure to do so. Additionally, where not otherwise prohibited by federal, state or local law or the terms of federal or state grants, all Construction Contracts shall contain a provision that requires the Contractor to use significant effort, and requires all Subcontractors to use significant effort, to ensure that no less than seven percent (7%) of the Resident Construction Worker Hours are performed by persons who qualify as unemployed.

 

(2) The percentage levels set forth in Sub-Section one (1) are intended as minimum requirements for use of Residents of the City of Rocky River under Construction Contracts and shall not be construed as limiting or deferring the full use of Residents of the City beyond this numerical level.

 

(B) REPORTING BY CONTRACTOR: MONITORING BY DIRECTOR:  DIRECTOR REPORTING TO COUNCIL.

 

(1) Prior to the commencement of work, each Contractor and Subcontractor shall complete and submit to the Director of Safety-Service a work force report. This document shall identify the estimated work force requirements for the duration of the job, broken down by trade and month. This report will also require a list of names of all residents working for said Contractor and/or said Subcontractor.  This document shall be revised as required, but not less than once a month.

 

(2) The Director shall separately monitor the use of Residents of the City on all applicable projects and shall report his findings in writing to the Clerk of City Council and the President of City Council, on a bimonthly basis.

 

(3) The Director may acquire affidavits and other supporting documentation from the Contractor and/or Subcontractor(s) to verify or clarify that an employee is a Resident when doubt or lack of clarity has arisen.

 

(C) EFFECTIVE DATE

This chapter shall be effective and be in force upon its passage and approval as of January 1 of the next year.

 

(D) DEFINITIONS

 

(1.)  "City" means the City of Rocky River, Ohio and of the County of Cuyahoga.

           

(2.)  "Construction Contract" means all agreements whereby the City either grants a privilege or is committed to expend or does expend its funds or other resources, or federal grant opportunities, including without limitation, Community Development Block Grants, Urban Development Action Grants and Economic Development Administration Grants, in an amount of $100,000 or more, for the erection, rehabilitation, improvement, alteration, conversion, extension, demolition or repair of improvements to real property, including facilities providing utility service and includes the supervision, inspection, and other on-site functions incidental to construction, but does not include professional services.  'Construction Contract' also includes all contracts that are entered into by a person or entity that receives a grant, loan, privilege, credit, or resources from the City, from its funds or from federal grant opportunities for the poor, minorities and/or unemployed in an amount of $100,000 or more, for the purpose of erecting, improving, rehabilitating, altering, converting, extending, demolishing, or repairing real property or improvements to real property.

           

(3.)  "Construction Worker Hours" means the total hours worked on a Construction Contract by Skilled and Unskilled Workers, whether those workers are employed by the Contractor and/or by the Subcontractor.           

           

(4.)  "Contractor" means all persons and/or companies receiving a Construction Contract from the City of Rocky River, a subdivision of the City, or an individual legally authorized to bind the City pursuant to said contract.

           

(5.)  "Director" means the Director of Safety-Service for the City of Rocky River, Ohio.

           

(6.) "Resident" or "Resident of the City" shall mean a person domiciled within the boundaries of The City of Rocky River.  The domicile is an individual's one and only true, fixed and permanent home and principal establishment.

           

(7.) "Subcontractor" means a person or company that assumes by secondary contract part and/or all of the obligation(s) of the original Contractor(s).
